What this is

W-8BEN is the Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting. In plain terms you tell the broker you are not a US person, so they withhold under the nonresident rules.

US persons should not file this form.

This follows the IRS form instructions, the public China-US income-tax treaty, and the renewal page inside a Schwab account. For a China tax resident, stock price gains are usually not withheld the way a US person pays capital-gains tax. Cash dividends can be withheld at 30% with no treaty claim. The treaty often caps dividends at 10% if you claim treaty benefits and the broker accepts the form. That is public tax-rule language. Personal filing still goes to an accountant. When to file

After the account is approved and login is stable. Complete Form W-8BEN may pop up after login, or sit in account documents. The same day you upload ID, most people cannot open it.

Renewal is about every three years. Schwab often shows a login banner. The page says the form expires at the end of the calendar year and asks you to recertify now.

What happens if you skip it is not identical at every desk. Schwab review copy has said sales and dividends may be withheld at a higher rate until the form is done. Some accounts first block buys. Do not test which path yours takes.

Before you start

Use a computer. Phone pop-ups drop mid-form. Apple machines in the community more often use Safari. Windows can try Edge. Allow pop-ups or the form page never opens.

Have the English name on the passport, the English pinyin residence address, tax-residence country China, and a China TIN. For mainland individuals that number is usually the 18-digit national ID. The name must match the passport.

If you want the Chinese UI, switch it before login. Sign out, pick Chinese under the login box, or use Log In at the top right. Field labels look similar in both languages. Legal text may stay English.

How to fill it

If the expiry banner appears, recertify now. The next page asks you to turn off the pop-up blocker, then continue to the Schwab site.

Confirm you are an individual and the name is all English. On foreign TIN, pick China and enter the national ID the way the form asks. That box sometimes will not accept input. The page may let you continue. Follow that day’s form text.

Contact fields also use the passport English name. Fill email and phone, then continue. Use +86 for the phone.

The terms page is long. Click only when you see ACCEPT. The page gives an e-sign confirmation code. Copy it. You need it at submit. You can also set an English hint question to recover the code.

On the legal statements, a typical mainland retail client checks no US citizenship and no US passport. If you have US status, stop using this guide.

On treaty benefits, a China resident can claim the China-US treaty. Dividends are often read at the 10% treaty cap. Checkboxes and article numbers follow that day’s form and the IRS treaty table. If a prompt appears, follow the page.

E-sign with the passport English name. Paste the confirmation code you copied. If you lost it, recover with the hint question and get a new one.

Before submit you certify two core lines. You are the person filing, and the person named on line 1 is not a US person.
